This meeting is compliant with the Governors Executive Order N-08-21 issued on June 11, 2021 allowing for deviation of teleconference rules required by the Brown Act. The purpose of this is to provide the safest environment for staff and the public while allowing for public participation. The meeting will be held by tele or video conferencing and in-person. The public may participate in the Planning Commission Meeting via Zoom Meeting or by attending in-person in the Council Chambers at 80 Fair Oaks Lane, Atherton, CA 94027.

3.        APPROVAL OF MINUTES –  April 27, 2022 Planning Commission Meeting


a. Tree Protection Zone (TPZ) Exception – 1 Nora Way, Atherton (059-313-010) *this item was continued from the April 27, 2022 Planning Commission meeting. Request for a Tree Protection Zone (TPZ) Exception to allow for reduced TPZ distances for two heritage trees; one heritage Redwood tree and one heritage Deodar Cedar tree. Atherton Municipal Code Chapter 8.10.

Recommendation: Approve the TPZ Exception.


b. Special Structures Permit – 401 Fletcher Drive, Atherton (APN 073-202-430) – Request for a Special Structures Permit (SSP) to exceed the maximum (30 feet) and sidewall height (22 feet) limit for the main residence by 1 foot 8.5 inches for the maximum height and 6.5 inches for the sidewall height.  Atherton Municipal Code Chapters 17.15, 17.32 and 17.42.

Recommendation: Continue the Special Structures Permit to a date uncertain.


c. Tree Protection Zone (TPZ) Exception – 268 Catalpa Drive, Atherton (APN 061-032-130) - Request for a Tree Protection Zone (TPZ) Exception to allow for a reduced TPZ distance for one heritage Coast Live Oak tree. Atherton Municipal Code Chapter 8.10.

Recommendation: Deny the TPZ Exception.


d. School Master Plan Update – 50 Valparaiso, Atherton / Menlo School (APN 070-360-080) - 2022 Annual Master Plan Update. Atherton Municipal Code Section 17.32.050.

Recommendation: Accept the 2022 Annual Master Plan Update.


e. Amendments to Atherton Municipal Code Chapter 17.50 “Landscape Screening” – Consideration of a recommendation to the City Council to adopt amendments to Chapter 17.50 “Landscape Screening”.  Atherton Municipal Code Chapters 17.06, 17.18 and 17.50.

Recommendation: Recommend that the City Council adopt the Atherton Municipal Code Amendments.


a. General Plan Consistency Determination for the Capital Improvement Program (CIP) for Fiscal Years 2022/2023 – 2026/2027.

Recommendation: Find Consistency with the Atherton General Plan.


7.        ADJOURN

If you challenge a Town zoning, planning, or any other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the City Council at, or prior to, the public hearing.  Judicial review of any Town administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final.  Judicial review of environmental determinations may be subject to a shorter time period.

Copies of all staff reports and documents subject to disclosure that relate to each item of business referred to on the agenda are available for public inspection by 5:00 p.m. the Friday before each regularly scheduled Planning Commission meeting at the Atherton Library, 2 Dinklespiel, Station Lane, and the Town Administrative Offices, 80 Fair Oaks Lane, Atherton, CA 94027.

In compliance with SB 343, materials related to an item on this Agenda submitted to the Planning Commission after distribution of the agenda packet are available for public inspection in the Town Administrative Offices, 80 Fair Oaks Lane, during normal business hours.

Planning Commission decisions are appealable by any aggrieved person to the City Council within 10 days of the date of the decision.
