2.         PUBLIC COMMENTS (only for items, which are not on the agenda - limit of 3 minutes per person)

3.         APPROVAL OF MINUTES –  July 22, 2020 Planning Commission Meeting.


a) Tree Protection Zone (TPZ) Exception- 2 Encino Road (APN 061-220-150)–Request for a TPZ Exception to allow for a heritage Coast Live Oak tree down to six-seven times the tree's diameter (6x-7x). Atherton Municipal Code Chapter 8.10.

Recommendation: Approve the Tree Protection Zone Exception.

b) Heritage Tree Removal (HTR) Permit - 83 Linda Vista Avenue (APN 070-142-100)- Request for a Heritage Tree Removal (HTR) Permit to allow for the removal of two (2) heritage Deodar Cedar trees. Atherton Municipal Code Chapter 8.10.

Recommendation: Approve the Heritage Tree Removal Permit.

c) Conditional Use Permit (CUP) - 50 Valparaiso Avenue, Menlo School (APN 070-360-080)- Request for a Conditional Use Permit (CUP) to allow five portable buildings to accommodate childcare for staff and faculty during the COVID-19 pandemic. Atherton Municipal Code Chapter 17.36.

Recommendation: Approve the Conditional Use Permit.  

d) Amendments to Atherton Municipal Code Chapters 17.52: Accessory Dwelling Units" and 17.60 "Definitions" - Consideration of a recommendation to the City Council for amendments to Chapter 17.52 "Accessory Dwelling Units" and Chapter 17.60 "Definitions" of the Atherton Municipal Code. Atherton Municipal Code Chapters 17.18, 17.52, 17.60.

Recommendation: Recommend
 that the City Council adopt the Municipal Code amendments.

If you challenge a Town zoning, planning, or any other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the City Council at, or prior to, the public hearing.  Judicial review of any Town administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final.  Judicial review of environmental determinations may be subject to a shorter time period.

Planning Commission decisions are appealable by any aggrieved person to the City Council within 10 days of the date of the decision.
