5. CITY MANAGER’S WRITTEN REPORT AND CERTIFICATION OF CONTINUING EMERGENCY AND RATIFICATION OF SUCH RULES AND REGULATIONS ENACTED BY THE DIRECTOR OF EMERGENCY SERVICES IN RESPONSE TO COVID-19
Discussion: The City Manager’s Report includes written reports from the Town’s various Departments. Staff is present to answer any questions the Council may have on the various issues noted in the written in the Reports.
Recommendation: It is recommended that the City Council certify the continuing emergency, and ratify such rules and regulations enacted by the Director of Emergency Services in response to COVID-19.

8. ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF ATHERTON FOR A DEBT POLICY RELATED TO THE ISSUANCE OF DEBT

Recommendation: Adopt a resolution for a Town Debt Policy related to the Issuance of Debt for the Town of Atherton.
Description: This item involves discussion and adoption of a Town Debt Management Policy related to the issuance of debt. The Debt Policy is a mandate for all municipalities that initiate financing and must comply with State law related to the management of debt. This Policy underlines guidelines and purposes of debt and will include discussion of purposes of which debt may be issued, types of debt, relationship of debt to Capital Improvement programming, planning goals and objectives. The Council will be adopting a Debt Policy as it approaches COP financing for the Town Center Project. This item may also discuss the Financing process for issuances of COP’s.
9. ADOPT A RESOLUTION APPROVING A PROJECT LIST FOR THE ROAD MAINTENANCE AND REHABILITATION ACT OF 2017 (SB1)

Recommendation: Adopt a Resolution approving a project list for the Road Maintenance and Rehabilitation Act of 2017 (SB1).
Description: This item involves the discussion of the Road Repair and Accountability Act of 2017 (SB1), adopting a project list and amending gas tax appropriations for fiscal year 2020-2021.
10. ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF ATHERTON ADOPTING DISCLOSURE POLICIES AND PROCEDURES RELATED TO INITIAL AND CONTINUING DISCLOSURE OBLIGATIONS ENTERED INTO IN CONNECTION WITH THE ISSUANCE OR INCURRENCE OF DEBT

Recommendation: Adopt a resolution adopting Disclosure Policies and Procedures for the Town of Atherton related to initial and continuing disclosure obligations entered into in connection with the issuance or incurrence of debt by the Town of Atherton.
Description: This item is the presentation of a resolution adopting Disclosure Policies and Procedures for the Town of Atherton related to initial and continuing disclosure obligations entered into in connection with the issuance or incurrence of debt by the Town of Atherton. As the Town is entering COP financing for the Civic Center. In connection with the execution and delivery of the COPs, the Town is required to comply with federal securities laws that govern the type of information that must be disclosed in connection with the offering of the COPs. In response to the SEC’s advice and in order to better monitor compliance with its disclosure undertakings, the City Council is being asked to consider adopting Disclosure Policies and Procedures. Discussion will include the process and procedures the Town will undertake to provide continuing disclosure to investors with annual reports and notices of certain events periodically so long as the COPs are outstanding.
PUBLIC HEARING (Items 11 – 12)
11. CONDUCT THE PUBLIC HEARING ON RECOMMENDED AMENDMENT TO AUTHORITY TO EXECUTE CONTRACTS; AND, IF APPROPRIATE, INTRODUCE FOR FIRST READING THE PROPOSED AMENDMENT TO CHAPTER 2, AUTHORIZING THE CITY MANAGER AND OTHER DESIGNATED TOWN OFFICIALS TO EXECUTE CONTRACTS

Recommendation: Conduct the Public Hearing; and, if appropriate, introduce for first reading the attached Ordinance, an Ordinance of the City Council of the Town of Atherton Amending Title 2, adding chapter 2.61 relating to authority to execute contracts, authorizing the City Manager and other designated Town officials to execute contracts.
Description: This item includes conducting a Public Hearing to introduce for first reading the attached Ordinance of the City Council of the Town of Atherton Amending Title 2, adding chapter 2.61 relating to authority to execute contracts, authorizing the City Manager and other designated Town officials to execute contracts. This item discusses that once the decision to initiate the sale of the COPs (Certificates of Participation) is made, signatures will be required on the necessary financing documents. The attached Ordinance allows for the City Manager to sign these documents. This item may also include discussion of the financing schedule to issue sale of COP’s. This Ordinance is consistent with current practice via the Town’s existing Ordinances. The Ordinance codifies the signature authorities into one Chapter of the Municipal Code.
12. PUBLIC HEARING TO CONSIDER ADOPTING A MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM, APPROVING A CONDITIONAL USE PERMIT AND DIRECT STAFF TO NEGOTIATION WITH MENLO SCHOOL AND MENLO COLLEGE FOR USE OF THE PROPERTY FOR THE CARTAN FIELD STORMWATER CAPTURE PROJECT, 30 ALEJANDRA AVENUE (APN 070-250-190)
Report: Town Planner, Lisa Costa Sanders and Planning Consultant, Neal Martin
Recommendation:
1. Approve the Resolution adopting the Findings of Fact, approving an Initial Study/Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program, and Conditional Use Permit for the Cartan Field Stormwater Capture Project; and
2. Direct staff to negotiate an Agreement with Menlo School and Menlo College for use of the property for the Cartan Field Stormwater Capture Project.
Description: This item will involve a public hearing and discussion by the Council on the Town’s proposal to construct a Stormwater Capture Facility consisting of a new underground storage tank with capacity to store up to 9 acre-feet of water (approximately 2.9 million gallons), new rubber dam, inlet and diversion structures located within the Atherton Channel, modifications to the existing trapezoidal channel, and, new structures and equipment to filter and remove mercury, PCBs, and other pollutants from stormwater flow. The Council will discuss the environmental effects of the proposed project as described in the Initial Study/Mitigated Negative Declaration for the project and will consider approving a Conditional Use Permit for the project and directing staff to negotiate an Agreement with Menlo School and Menlo College for use of their property to construct and operate the project. Ultimately, staff is recommending that the Council adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, approve the Conditional Use Permit and provide direction to staff.

13. REVIEW AND DISCUSSION OF POTENTIAL REVENUE AND EXPENDITURE IMPACTS DUE TO COVID-19 FOR FISCAL YEAR 2019/20 AND 2020/21

Recommendation: Review and discuss the potential revenue and expenditure impacts due to COVID-19 for FY 2019/20 and 2020/21.
Description: This item reviews and discusses the potential revenue and expenditure impacts due to COVID-19 for FY 2019/20 and 2020/21. This item provides a review of the FY 2019/20 Budget expectations and a brief look at FY 2020/21 projections. Discussions to include General Fund Revenues of which a majority comprise of Property Taxes, ERAF, and Charges for Services. It is anticipated that COVID-19 is a limited term impact with a fairly robust and quick recovery period. This item discusses potential impacts the Shelter in Place Order will have on Town revenues and operations. If COVID-19 persists, there could be operational changes at all levels of public and private sector operations for an extended period of time. This Revenue and Expenditure Report provides trends and updates on the potential impacts of the COVID-19 and the known unanticipated changes to the operations of the Town.
